TERMS AND CONDITIONS – BIGPAY AND AIRASIA/SUPER APP ACCOUNT LINKAGE  

 

This document contains the Terms and Conditions governing the linkage of your BigPay e-wallet account issued and operated by BigPay Malaysia Sdn Bhd (“BigPay”, “we” or “us”) with your AirAsia account on the mobile application known as the “AirAsia SuperApp” operated by AirAsia Com Travel Sdn Bhd (“AACT”), an affiliate of BigPay.

 

By clicking the “I agree” button in the AirAsia SuperApp and/or continuing with the BigPay and AirAsia account linkage function, you are deemed to have agreed to and accepted these Terms and Conditions (and any additional terms and conditions stipulated by BigPay from time to time) which shall be legally binding.

 

1.         To proceed with the account linkage, you must first be a BigPay member (whose account has not been blocked or suspended by BigPay) and an AirAsia registered member.

 

2.         In order for you to link your BigPay e-wallet with your AirAsia account via the AirAsia SuperApp (to be able to thereafter top-up your BigPay e-wallet, view your BigPay account balance and make payment with your BigPay e-wallet directly within the AirAsia SuperApp), you must first authenticate and consent to the linkage via your BigPay mobile application (“BigPay App”).      

 

3.         You acknowledge and agree that in order for us to provide you with the services, features, functions, benefits, offers and/or privileges related to the account linkage between your BigPay e-wallet account and your AirAsia account (including allowing you to view your BigPay account balance, top-up your BigPay account and make payments with your BigPay e-wallet directly within the AirAsia SuperApp), including the processing of any transaction effected or to be effected through the use of your BigPay e-wallet within the AirAsia SuperApp, the sharing, transfer, retrieval, updating and processing of your personal information, mobile number, BigPay account and transactional details, data exchange as well as the creation of member profiles and/or user accounts and updating of personal details may occur between BigPay and AACT, including our parent, ultimate shareholder, our related companies, subsidiaries, associates and/or affiliates (“AirAsia Group”), service providers, merchants and any other parties engaged by us to enable or assist us in the provision of services to you or to facilitate the linkage of the BigPay e-wallet with your AirAsia account and the provision of the services in connection thereto, as further stated in our Privacy Policyand you have consented to the same;

 

4.         By linking your BigPay e-wallet account with your AirAsia account, you agree to BigPay notifying AACT of your BigPay account balance (including via APIs) in order for AACT to display the same on the AirAsia SuperApp and for BigPay to notify AACT of any account or transactional details/history in relation to your BigPay e-wallet to facilitate the top-up of funds to your BigPay account and in order for you to make payment via your BigPay e-wallet within the AirAsia SuperApp.

 

5.         Your BigPay e-wallet account can only be linked to one (1) AirAsia account on the AirAsia SuperApp at any given time. If your BigPay account is linked to another AirAsia SuperApp account, any previous link will be disabled or invalidated.

 

6.         The consent to link your BigPay e-wallet and AirAsia account on the AirAsia  SuperApp is only available for a short period of time as determined by BigPay. After expiry, the “consent” cannot be used and a new consent must be obtained to restart the process for the linkage. Consent to link your BigPay account and AirAsia account can only be done via your BigPay App with the authorisation methods in place.

 

7.         Once you have linked your BigPay and AirAsia accounts on the AirAsia SuperApp, this linkage will become ‘inactive’ in one (1) year or ninety (90) days from the last transactional activity on the AirAsia SuperApp, whichever is earlier. To re-activate, you will need to re-authenticate and re-authorise the linkage via your BigPay App.

 

8.         Both your BigPay App and the AirAsia SuperApp must be installed on the same mobile device for the linkage to be completed successfully.

 

9.         Once your BigPay e-wallet account is linked with your AirAsia account, you can make payments via your BigPay e-wallet directly within the AirAsia SuperApp for products and services provided by AirAsia Group (including any products and services offered within the AirAsia Group ecosystem) and products and services offered by third party merchants within the AirAsia SuperApp. You cannot make payments for products and services offered by merchants that are not listed within the AirAsia SuperApp.

 

10.       Once your BigPay e-wallet account and AirAsia account is linked, you can select your BigPay e-wallet which will appear as an available payment method during the Checkout screen on the AirAsia SuperApp.

 

11.       In order to complete payment for purchases within the AirAsia SuperApp with your BigPay e-wallet, you must approve and authorise each payment individually in your BigPay App.

 

12.       With respect to any refunds due to you (for example, if you later cancel your purchase, the transaction has been declined or the merchant does not complete the transaction or deliver the services or goods amongst others), such refunds will be paid back (once cleared via AACT, AirAsia Group or the respective merchant who offered the product or service) to your BigPay e-wallet i.e. the source from where the payment was originally made for the transaction.

 

13.       For security reasons, you cannot link your BigPay account and AirAsia account on a jail broken or rooted mobile device nor make payments via your BigPay e-wallet on a jail broken or rooted mobile device. If we or AACT detect that your mobile device is jail broken or rooted, your account linkage will be terminated or blocked.

 

14.       Your account linkage and transactions via your BigPay e-wallet on the AirAsia SuperApp continue to be subject to our fraud and money laundering / terrorism financing transaction monitoring and the applicable controls and rules and security measures as stated in the BigPay Cardholder Agreement.

15.    We and/or AACT may at any material time decide not to process your request or payment transaction via your BigPay e-wallet on the AirAsia SuperApp or block or terminate your account linkage and to take any further action as may be appropriate if we suspect you are or may be involved in fraudulent, money laundering, terrorism financing, fraudulent, suspicious or illegal activities.

16.       If your BigPay e-wallet account is blocked, suspended or we have reasons to suspect that there are fraudulent, suspicious or illegal activities on your account or transactions, you will not be able to link your BigPay e-wallet account with your AirAsia account and any prior linkage will be terminated.

 

17.       All products and services displayed on the AirAsia SuperApp are subject to AirAsia SuperApp’s, AirAsia Group’s or the respective merchant’s own terms and conditions. All queries related to flight bookings must be addressed to AirAsia. AirAsia SuperApp, AirAsia Group and the respective merchants may impose and/or change any conditions applicable to the products and services offered on the AirAsia SuperApp without prior notice.

 

18.       BigPay is not liable for any issues or disputes (including delay, discrepancy, merchantability, fitness for purpose and others) that you may raise with respect to the products and services displayed on the AirAsia SuperApp or which you have purchased on the AirAsia SuperApp and you will need to deal directly with AirAsia SuperApp and/or AirAsia Group in respect thereof.

 

19.      You shall ensure that sufficient funds are kept in your BigPay e-wallet to facilitate payment for all transactions and payments made with your BigPay e-wallet on the AirAsia SuperApp and shall be liable for all transactions and payments made with your BigPay e-wallet on the AirAsia SuperApp. BigPay and AACT shall not be liable for such disputes or claims of fraud or unauthorised payments nor liable for any refunds that you may claim in respect thereof.

 

20.      BigPay shall not be liable for processing errors or system issues on the AirAsia SuperApp (including but not limited to any error including but not limited to incorrect payments or transactions, incorrect amounts, duplicate processing, neglect, refusal or omission to make, or delay in making, any and all payments to the merchants) and such issues shall be referred to or you shall deal directly with AirAsia SuperApp with respect to the same.

 

21.       You hereby agree to indemnify and to keep BigPay indemnified against any claims, losses, damages, costs, and expenses that BigPay may incur arising from your authorisation and request to link your BigPay account with your AirAsia account,  display the transactional details/history in relation to your BigPay e-wallet to facilitate the top-up of funds to your BigPay account and in order for you to make payment via your BigPay e-wallet within the AirAsia SuperApp, due to any reason whatsoever except due to the gross negligence or wilful default of BigPay.

 

22.      You may “unlink” your BigPay account from your AirAsia account at any time by contacting BigPay’s customer support or via a function within the AirAsia SuperApp.

 

23.       BigPay reserves the absolute right to impose any fraud rules, security controls or authorization limits for payments made via your BigPay e-wallet on the AirAsia SuperApp and/or change any conditions applicable to the linkage of your BigPay e-wallet account and the AirAsia account from time to time without prior notice

  

24.      BigPay reserves the absolute right to suspend or terminate the account linkage feature and function at any time without having to provide any reasons. For the avoidance of doubt, suspension or termination shall not entitle you or any person to any claim against or demand compensation from BigPay (and AACT) for any losses, damages, costs or expenses suffered or incurred as a direct or indirect result of the suspension or termination.

 

25.       These Terms and Conditions shall prevail over any inconsistent terms, conditions, provisions or representations contained in any other promotional or advertising materials for the account linkage. BigPay reserves the absolute right to vary, delete or incorporate any additions to these Terms and Conditions (wholly or in part) from time to time without any prior notice. These terms and conditions shall also be read together with the BigPay Cardholder Agreement

 

26.       BigPay’s (and AACT’s) decisions in relation to all aspects of the linkage between your BigPay e-wallet account and the AirAsia account is final, binding and conclusive under all circumstances and no complaint or dissatisfaction will be entertained

 

27.      BigPay shall bear no responsibility for any damage, loss (including but not limited to direct, indirect and consequential loss), liability, injury or disappointment incurred or suffered by any party in connection with the account linkage feature.
